1. Scope of These Terms
These Terms and Conditions (“Terms”) govern your access to and use of the website located at emalfarblaw.com (the “Site”) and any legal services provided by Emalfarb Law LLC (“Firm,” “we,” or “us”), an Illinois law firm. By using the Site or engaging the Firm for legal services, you agree to be bound by these Terms. If you do not agree, do not use the Site or submit any inquiry through it.
These Terms apply to all visitors, prospective clients, and clients. They do not create an attorney-client relationship. An attorney-client relationship is established only upon the Firm’s written acceptance of representation and execution of a separate engagement agreement.
2. No Attorney-Client Relationship; No Legal Advice
The information published on this Site is provided for general informational purposes only. It does not constitute legal advice and does not create an attorney-client relationship between you and the Firm or any of its attorneys. Submitting a contact form, intake form, or inquiry through this Site does not establish an attorney-client relationship. The Firm is not your attorney until a written engagement agreement has been signed by both parties.

3. Legal Services
The Firm provides legal services in connection with Illinois mechanic lien law, construction payment disputes, payment bond claims, and related matters as described on the Site. The scope of any legal representation, applicable fees, and applicable terms will be set forth in a separate written engagement agreement between the Firm and the client.
Nothing in these Terms modifies or supersedes the terms of any executed engagement agreement. In the event of a conflict between these Terms and a written engagement agreement, the engagement agreement controls.
4. Mechanic Lien Deadlines — Your Responsibility
Illinois mechanic lien law imposes strict statutory deadlines under the Illinois Mechanics Lien Act (770 ILCS 60). Missing these deadlines may permanently extinguish your lien rights. The deadline information published on this Site is provided for general educational purposes only and may not reflect recent changes in the law or apply to the specific facts of your matter.
You are solely responsible for ensuring that any mechanic lien notices are served and any lien claims are recorded within the time periods required by applicable law. The Firm assumes no responsibility for missed deadlines arising from your failure to timely retain counsel or from your reliance on general information published on this Site. 10. Geographic Scope
The Firm’s legal services are focused on Illinois construction law matters. Nothing on this Site constitutes an offer to provide legal services in any jurisdiction where the Firm’s attorneys are not licensed or where such an offer would be prohibited.
11. Dispute Resolution
Any dispute arising out of or relating to these Terms or your use of this Site that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association in Cook County, Illinois. The arbitrator may award relief only on an individual basis and only to the extent necessary to resolve the individual claim. Nothing in this Section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict-of-law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Cook County, Illinois.
13. Modifications
The Firm reserves the right to modify these Terms at any time. Changes are effective upon posting to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. The “Last Updated” date at the top of this page reflects the date of the most recent revision.
